Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and Spot Around Me ("we", "us", "our") governing your use of the Spot Around Me mobile app and related services (the "Service"). By downloading, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your region) and able to form a binding contract to use the Service. By using it, you represent that you meet these requirements.

2. Your account

• You are responsible for the accuracy of the information you provide and for keeping your login credentials secure.
• You are responsible for all activity under your account. Notify us promptly of any unauthorized use.
• You may delete your account at any time from the app's Profile settings.

3. Subscriptions & payments

• Some features require a paid subscription. Subscriptions are sold and billed through the Apple App Store or Google Play, subject to their terms.
• Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period. Manage or cancel your subscription in your App Store or Google Play account settings.
• Payment is charged to your store account at confirmation of purchase and upon each renewal. Refunds, where available, are handled by Apple or Google under their policies.
• We may change subscription features or pricing on a prospective basis; changes will not affect a term you've already paid for.

4. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Copy, scrape, harvest, or systematically extract data from the Service, or resell or redistribute it, except as expressly permitted.
• Reverse engineer, decompile, or attempt to derive source code, except where such restriction is prohibited by law.
• Interfere with or disrupt the Service, its security, or its infrastructure, or attempt unauthorized access.
• Upload content that is illegal, infringing, harmful, or that you don't have the right to share.

5. Your content

You retain ownership of the content you create in the Service (such as your notes and photos). You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that content solely to operate and improve the Service. You are responsible for your content and represent that you have the rights to it.

6. Our intellectual property

The Service — including the app, the Neighborhood Fit scoring, software, design, text, graphics, logos, and the "Spot Around Me" name and marks — is owned by us or our licensors and protected by intellectual-property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service for your own non-commercial use, subject to these Terms. No other rights are granted.

7. Informational only — no professional advice

The Service is not a substitute for professional real-estate, legal, financial, safety, or inspection advice, and does not constitute a recommendation to buy, rent, or pass on any property. Always independently verify any information — and consult qualified professionals — before making real-estate or financial decisions. We do not guarantee any outcome.

8. Third-party data & services

The Service incorporates data and services from third parties (for example, mapping and places data, local events, and AI text generation). We do not control and are not responsible for the accuracy, availability, or content of third-party data or services, and their use may be subject to their own terms.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DATA OR SCORE IS ACCURATE OR COMPLETE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD $50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold us harmless from claims, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms or applicable law.

12. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination (such as Sections 5–11) will survive.

13. Changes, governing law & contact

We may update these Terms from time to time; we will revise the "Last updated" date and, for material changes, provide additional notice. Your continued use after changes take effect means you accept the revised Terms.
